Rally - Mull Murmurs

Just as there are good laws and there are bad laws, there are well-written laws and poorly written laws. Not everyone gets everything right first time and that applies equally to the most learned in our society as it does to the rest of us.

On that basis, what follows is not to be regarded as fact, but more one person's version of possible events set out in a non-prejudicial way leading us to where we are today. The following was written by the author of that scurrilous series of on-event Bulletins 'Mull Murmurs' which were a feature of early Mull rallies and therefore should be treated with a fair degree of suspicion. Naturally, I personally deny all knowledge of said individual and do not necessarily subscribe to any of his views, opinions or fancies.

     He goes on:

" It would appear that the current stramash in which Scottish closed road rallying finds itself dates back to the original Act of Parliament in 1990 which was primarily enacted for Mull. That Act contained a clause headed up 'Compensation'.  It also featured in the more recent 1996 Act which enabled the Jim Clark event.

In those more innocent days before the advent of ambulance chasers and pin-striped litigants, TV and telephone call claims specialists, the wording was of a nature that would imply that anyone injured during the course of an event was entitled to compensation. I won't repeat the full Clause here in case others may be so encouraged, but suffice to say that in light of events in the Scottish Borders, some sharp-suit may have spotted a loophole, hence the current, and understandable, state of nervousness ahead of the FAI.

There is also a lack of understanding why the Snowman and Jim Clark accidents are the subject of a joint FAI because the circumstances around both are entirely different. One involved a spectator and the other one didn't! Hopefully they will be regarded as such on the day, or the 7 weeks to be more precise.

However, in the light of this latter incident it would appear that someone of quizzical mind and material nature has chosen to interpret the intention of this 'Compensation Clause' rather differently and no doubt the final outcome of the FAI will have a bearing on subsequent actions.

Needless to say the wording in the more recent Act of the Westminster Parliament as pursued by the MSA is slightly different to those original Acts and this may also have had a bearing on how the wording and meaning of the previous Acts were interpreted.

To say that this year's event has been cancelled simply because adequate and affordable insurance could not be sourced is therefore a wee bit misleading. It stems from a questionable legal interpretation and insurers are always suspicious of uncertainty. In light of recent events, their lawyers have probably looked at the Clause and erred on the side of caution - to the sport's loss.

In other words, either the Scottish Government will have to update these earlier Acts or simply adopt the new 'English' Act."

Signed - Yer auld pal, JB

As I said, the previous piece came from a thoroughly unreliable source and nowt to do with me. I am innocent of all insinuations and charges. I remain impartial, but in a bid to provide information without prejudicing the forthcoming Inquiry - a big boy wrote it and ran away.

There is a wider issue here. Other sports could be similarly affected if relying on 'old' legislation. We live in worrying times, eh?

No doubt I will return to this topic in due course !!

Rally - Mull threat

It would make a strong man weep in his porridge. The shock news this morning is that the MSA finds itself unable to issue a Permit for this year's Closed Public Road Mull Rally. This is due entirely for insurance reasons which no doubt are being further influenced by the ramifications around the FAI which is due to start next month.

Plans were already well underway and a route formulated for this October's event, with the organising team and the Muileachs unaware that doubts were already being raised in corridors and meeting rooms far to the south. So the news has hit them like a bolt from the blue.

But rally folks are a resilient bunch, by gawd they have to be these days, and thoughts are already turning to a different 'event' on rally weekend this October, so please keep the date free in the meantime.

On a political front, little can be done at present due to the General Election, and no doubt our dearly beloved MPs will have other things on their mind when Parliament resumes afterwards, but it would appear that this is entirely a Scottish legal matter so perhaps there is a glimmer of hope that something can be done up here.

If the Scottish Government wants to demonstrate its 'independence' here's a chance, get the Scottish legislation sorted and approved without waiting for the Westminster lot to get back to work, and get it done now! Rally folks are tax payers and government funders too you know.

Michael Russell (SNP) is the Constituency MSP for Argyll and Bute. Email: Michael.Russell.msp@parliament.scot. Or write to him at The Scottish Parliament, Edinburgh, EH99 1SP - and ask him what he proposes to do about this and how quickly?

This is not just a minor sporting matter, this event has a huge economic and social impact on an island community. That should concern him rather more than a mere 'sporting matter'.

No doubt I shall return to this topic in due course !!

Jim Clark Memorial Award

There was a wee surprise, or maybe that should be a big surprise, because  there wasn't just one individual winner in this year's Jim Clark Memorial Awards, it was presented to a whole family!

Last weekend the Association of Scottish Motoring Writers made their annual presentation to the Franchitti family.

Sponsored by Ford Motor Company this annual award recognises the efforts of Scots who have made a significant contribution to the world of motoring or achieved great success on track or stage.

The occasion marked a 'first' for this 47th year of the Jim Clark Award as it recognised a truly unique family achievement. George and Marina with their 'boys' Dario and Marino and daughter Carla have added another chapter to the book of Scottish motoring and motor sporting success.

This remarkable wee corner of north west Europe has punched well above its weight in the motoring sporting world. In the past 60 years Scotland has produced 8 World Champions on 2, 3 and 4 wheels.

Road - Trade routes

In the past couple of weeks, the news agenda has been dominated by tragedy and politics, but life goes on, and so does business.

Almost overlooked by all the main news outlets was one rather historical automotive moment. Not as important as other matters dominating the headlines, but significant as far as Europe, Brexit and business are concerned.

Last week Volvo Cars became the first car maker in the world to export China-made cars to Europe by train via China’s new ‘One Belt, One Road’ trade initiative. Perhaps the Great Wall isn't quite so far away any more!

The rail route was opened up earlier this year with Volvo becoming the first car maker to make use of it. Specially adapted containers can each carry three cars on the 7,500 mile trip through Kazakhstan and Russia and on into Europe which will take around 15 days as opposed to a 30 day sea trip.

Not only is it quicker but rail transport could reduce CO2 emissions by up to a half. There is also the added benefit of customers waiting less time for their new Chinese built S90!

Trouble is, the Europeans might just take a leaf out of Mr Trump's book and build their own wall along their eastern border! More trade barriers to negotiate, eh?

Rally - RSAC event news

That's the News & Blethers from the RSAC Scottish Rally published in the on-line mag, plus one or two other wee news snippets. Maybe it was too wet for funny stories or maybe folk were just too drookit to take the time, hopefully they'll do better next time. Anyway, that's the Scottish dealt with, now on with the Granite at Leuchars report and roundup.

Oh! The pic? That's Mary McPoppins with the wellies and brolly!
